Swedish law on child punishment

Parental Code

Chapter 6, section 1.

1 § A child has the right to care, security and good upbringing. A child shall be treated with respect for its person and individuality and may not be subjected to physical punishment or other insulting behavior.  

Criminal Code 

Chapter 3 sections 5 and 6.

5 § A person who causes another person bodily harm, illness or pain or puts that person in a position of powerlessness, is to be sentenced for assault to prison for at most two years or, if the crime is slight, to a fine. 

6 § If the crime referred to in section 5 is considered to be grave, then for grave assault the person is to be sentenced to prison for at least two, and at most ten years. 

FB 6. Om vårdnad och umgänge.

1 § Barn har rätt till omvårdnad, trygghet och en god fostran. Barn skall behandlas med aktning för sin person och egenart och får inte utsättas för kroppslig bestraffning eller annan kränkande behandling.

5 § Den som tillfogar anna person kroppskada, sjukdom eller smärta eller försätter honom I vanmakt eller annat sådant tillstånd, dömes för misshandel till fängelse I högst två år eller, om brottet är ringa, till böter.

6 § Är brott som i 5 § sägs att anse som grovt, skall för grov misshandel dömas till fängelse, lägst ett och högst tio år.
